He had plenty of time to move out of the way if he didn’t spend so much time getting his gun out. Dude had to take two steps to his right but opted to pull out a gun against a car instead. Afterwards you can hear him call her a “fucking bitch.” I’m pretty sure this dude just wanted to kill her because they were taunting him.

And to those that say “maybe you shouldn’t talk like that to law enforcement” maybe you should really think to yourself does that really justify getting shot in the head? Just because this guy didn’t like what she said doesn’t mean anyone deserved to die.
