Highly dependent on your states laws, your lawyers skills, and the corruption level of the prosecutor/judge/jury. In my state you can use lethal force to defend yourself if you feel like your life was being threatened. You can’t shoot law enforcement though and this “looks” like a police action she stumbled into. If a shot rang out, she probably wouldn’t make it to court. That’s why they move in packs of four or more and haven’t been wearing body cams.
My instant instinct was to shoot him. FFS, an unidentified man approaches my car and waves a pistol at me and my family?! That’s what it looked like, but context is king.
I’d almost certainly not live to see such a test case play out, but I’m not laying down either. I now travel with a pistol under my thigh, ready to go. If I went back in time and told young me this is how I live in 2025, young me would have shit bricks.
But /u/TheAsianDonKnots is 100%. State laws vary wildly, though all allow self-defense in at least some fashion. Remember that kid who shot the YouTuber hassling him in the food court?
Here’s a breakdown by well-known GunTuber and attorney James Reeves. Damned interesting seeing how the law, and what’s presented to the jury, hinges on the legal fine print. Gun nuts and haters both think they have a take on self-defense shooting. Both are usually wrong. (Kid got off BTW, and I think he should have.)
Also interesting that the kid popped him with a .380 and the guy just walked off, not even trailing blood. Anyone watching the video will be bummed the kid didn’t pull a Mozambique drill on this asshole, two in the chest, one in the head. 🙄
What happens when you shoot under cover cop because he pulled a gun on you without saying he’s police? It’s just hypothetical situation.
