So in this hypothetical scenario, instead of laying the bike down or just full-on bailing as soon as there was a catastrophic failure, he continues to proceed down the town’s streets, waiting for… what, exactly? The side of a building, people crossing the street, a group of absorbant children playing…?
Like yeah it’s technically a possibility, but if anything that makes the guy look even dumber. Then we get into things like ‘poor maintenance’ and root causes for the failure…
From a legal standpoint, I would definitely not try that angle. Even if everything was fine until the few seconds before that intersection, care and maintenance is going to be scrutinized so hard.
